This agreement is between Sage Investors, Inc. (SII) and those who subscribe (Subscriber) to our data service.Service Description
Sage Investors, Inc. (SII) provides specific end-of-day (the days the stock market is open) stock and option data that is useful to some investors. Sage provides some, but not all, of the data needed to carry out successful transactions.
Subscriber specifically recognizes that some of the deals presented in the data will not always be profitable and that it is Subscriber's responsibility to do the research necessary to decide which deals to transact. SII is not a stock broker or financial advisor, merely a data provider. The information provided on SII's World Wide Web site or in any literature published by Sage is intended as general educational material and is not a recommendation for any specific financial transactions. Sage encourages Subscriber to consult with one of the many licensed professionals that provide investment advice before risking any money.
Service Usage
This agreement is intended to make the supplied data available for the sole use of Subscriber and does not extend to any other person or entity. In the event that SII may at any time believe that the data is being provided by Subscriber to any third party, SII may immediately discontinue service to Subscriber without liability other than the refund of unearned prepaid service fees.
Warranties
Subscriber acknowledges that SII makes absolutely no warranties whatsoever, express or implied, with respect to the data provided. Each participating national securities exchange or association asserts a proprietary interest in all of the market data it furnishes to parties that disseminate said data. Subscriber acknowledges that neither SII nor any participating national securities exchange or association nor any supplier of market data guarantees the timeliness, sequence, accuracy, completeness, reliability or content of market information, or messages disseminated to or by any party. Subscriber acknowledges that neither SII nor any participating national securities exchange or association nor any supplier of market data warrants that the service will be uninterrupted or error-free. Subscriber agrees that your use of our web site or any of our services is at your sole risk. The service is provided on an "as is", "as available" basis without warranties of any kind, either express or implied, including, without limitation, those of merchantability and fitness for a particular purpose, other than those warranties which are implied by and incapable of exclusion, restriction or modification under the laws applicable to this agreement. In order for SII to provide the data in a timely manner, several computer systems over which SII has no control must be functioning correctly.
Subscription Fees
Subscriber will pay for service via Paypal.com using one of the plans offered at http://sage1.com/sub.php. The amount charged will be the then currently published price of the plan chosen by Customer. SII will give thirty days notice via the web site of any change in fees. Subscribers may cancel their subscription at any time by choosing the Cancel menu button.Entire Agreement
This instrument constitutes the entire agreement between the parties. In the event that any term or provision of this agreement is held by a court to be unenforceable, then the remaining provisions of this instrument and the agreement which it evidences, shall remain in full force and effect.
